Hi Char, it depends on the TYPE of work they are doing, what your state permits, and if you’re providing the employee/contractor the equipment and workspace. My recommendation is to reach out to me directly or speak to your CPA for a better understanding of the laws. Great question and thank you for writing in!

I have a question regarding the w2 vs 1099 rule. I have employees that come in strictly to complete piece work. They are not given a normal work schedule their position is limited to a certain of the year and the rest of the time they do not work? We currently pay as a 1099. Is this the correct method?
