Constitutional textualism is analogous to religious fundamentalism. Both attract the black-and-white personality that reduces complexities by rationalizing the irrelevance of gray areas and complicated realities. It doesn’t lend itself to fact-based judgements and creates the kind of chaos one sees in the plethora of denominations within Protestantism. Even some within the Federalist tradition are criticizing the misapplication of methodologies by conservative Justices.

I enjoyed listening to Liev Schreiber. However my family left the Soviet Ukraine in 1922. They survived the worst pogrom in the civil war, over 2000 Jews were killed over two days. Later my mother and her family lived in Kiev for two years. They decided to escape and made it into Lyov which was in Poland at that time. During the entire time growing up I never heard any reference to Ukraine or Ukrainians, it was all “Russia and Russian “.

How to stop a compulsive talker: For me it is raising my finger and saying ’hold that thought, we will continue next time we meet. The thing is I love talking to people but after street of many ideas all at once my brain needs a rest.

So happy to see this podcast has made it to ! Used to listen to this when I was with Stitcher and was disappointed when I switched to and couldn’t find this podcast. Great to see that Alan and Clear and Vivid are now on .
