Today on the podcast, we dive into the question of what kinds of musical borrowing constitute "influence" versus "plagiarism." In the news at the moment is a lawsuit against pop singer-songwriter Ed Sheeran, who is accused of lifting parts of Marvin Gaye's "Let's Get It On" for his song "Thinking Out Loud." We're going to listen to both songs, and you can decide what you think. But we're also going to go on a tour through musical history and see how supposed "original" artists are often blatant plagiarists. We're also going to discuss the history of the exploitation of Black music by white artists and the question of who should owe what to whom when someone gets rich off a song based in part on someone else's song.
This audio essay is adapted from Nathan's recent Current Affairs article "The Ed Sheeran Copyright Lawsuit Exposes The Absurdity of Music Ownership." A playlist of songs played in the episode (plus a few more involved in plagiarism cases) is available on Spotify.
