Marc: A patent protects an invention, it could be an article of manufacture or a process, it could be a method. And, patents protect something that does something or that is made in a certain way. There's also something called a design patent which does protect the aesthetic of an otherwise utilitarian product, so the way something looks. Trademarks protect the source of origin of a brand. Marc: A patent protects an invention, it could be an article of manufacture or a process, it could be a method. And, patents protect something that does something or that is made in a certain way. There's also something called a design patent which does protect the aesthetic of an otherwise utilitarian product, so the way something looks. Trademarks protect the source of origin of a brand. So, that could be a slogan, a logo, a brand name, it could actually be a color or a smell, but it's something that tells you the source of the goods or services. So, a trademark and a patent protect different aspects of a product, and it's possible to get patent and trademark and even copyright protection on the same product, but you're protecting different aspects of that same product.
