In Duluth, Minnesota three activists --Scot Bol, Michael Niemi and Ernesto Burbank-- locked themselves to the entrances to Wells Fargo to protest the bank’s investments in Enbridge Energy Partners, a corporation building tar sands pipelines in the Midwest. At trial, the defendants offered a "necessity defense," arguing they had no choice but to act outside the law in conscientious civil disobedience in the face of impending climate catastrophe. J.T. Haines, one of the defense attorneys in the case, talks to Matt about the legal theory, and the importance of its use in coming legal battles over human response to climate crises.
