村支书占孤儿款为何不判刑？无利用职务便利情节，目前看处理正常

日前湖南公布一起村支书非法占有孤儿补贴款的典型案例，其被除以党纪处分并退缴涉案款，尽管其道德层间非常恶劣，但由于其并非经手人不涉利用职务便利，是由于民政局打款错误所知，因此无法以职务侵占等刑事罪名追责，类比相关案例目前看处理属于正常情况。
